Which Laws Govern Insurance and Mediclaim Rejection in India?
The policy contract is governed by the Insurance Act, 19 38, the IRDA Act, 19 99, the relevant IRDAI instruments and the Consumer Protection Act, 2019. The policy wording provides the cover. The regulatory rules control insurer behaviour. Consumer law provides remedies if there is proof of deficiency in service. Section 2(42) defines insurance as “service”. Section 2(11) refers to any fault, imperfection, shortcoming or inadequacy in the performance of a contract or required by law to be performed. If there is proof of deficiency, Section 39 provides for relief including removal of the deficiency and compensation for proven loss or injury. Interest and costs are at the discretion of the forum.
Repudiation or partial denial under the IRDAI scheme should provide reasons related to policy provisions. The policyholder can first complain to the insurer and then utilise the IRDAI complaint mechanism. Eligibility for the Ombudsman has a ?50 lakh ceiling, is subject to a one-year timeline from the date of the grievance response and cannot be selected if the same matter has been approached elsewhere. There is a separate route through the consumer commissions. Under the rules from 20 21, the District Commission has jurisdiction for up to ?50 lakh consideration; State Commission for more than ?50 lakh and up to ?2 crore; and National Commission for more than ?2 crore. The NCDRC also has powers of statutory appeal and revision. Condonation of delay is possible if sufficient cause is established, but frequent calls/emails to the insurer will not automatically toll limitation.

Read the wording and amount carefully before signing. Agreeing to “full and final settlement” of a dispute may prevent you from contesting the insurer’s decision later.
