Which Consumer Law and Commission Apply?
Sections 34, 35, 47 and 58 of Consumer Protection Act, 2019 deal with territorial and pecuniary jurisdiction of the District Commission, State Commission and National Commission. Briefly, the current pecuniary jurisdiction is as follows: –
- District Commission – Up to ?50 lakh
- State Commission – Above ?50 lakh and up to ?2 crore
- National Commission – Above ?2 crore
These limits are in terms of the value of consideration paid for goods or services. Hence, the limit is not based on the refund or compensation sought. For example, a person who paid ?20 lakh as consideration but is claiming a lot more as compensation shall not normally be able to file directly with the National Commission just because of the higher claim amount.
Jurisdiction is also a matter of territorial local/native limits. Jurisdiction can lie in a District or State or at the National level, depending on where the opposite party resides or conducts business, or where cause of action arose, or where the complainant resides or works for gain etc., based on the applicable provision and facts.
Limitation of two years from cause of action is laid down in Section 69. A complaint received after the expiry of the specified period may be entertained if the complainant satisfies the Forum that he has sufficient cause for not filing the complaint within such period; however condonation of delay is at the discretion of the Forum.
