Who Can File a Consumer Complaint?

A consumer is any person who buys goods or services for personal consumption. If you paid for a travel package, you are a consumer.

Who Is Liable?

Under the Consumer Protection Act, there are three layers of liability. The first is the selling travel agency (“agency” from here on). But what if you booked through TravelBazzar’s franchise in Kochi or Chandigarh? Even if you booked online directly from their portal they cannot contract out of their duties under consumer law.

Is Travel Package Fraud Illegal?

Both. Criminal & civil laws cover deceptive trade practices. Which court can I approach?

What Is Travel Package Fraud?

Essentially – anything where a travel agent or operator lies about a product, and the consumer suffers loss as a result. Travel package fraud can be intentional deception (a criminal matter). It can also be negligent misrepresentation causing travel consumer loss (civil).

7 Types of Travel Package Fraud in India

Frauds we’ve seen represent clients on include:

  1. Hotel misrepresented in brochure – agents show you photos of Hilton hotels, name it in the itinerary. But your family stays at budget lodges. It’s one of the top grievances consumer forums see.
  2. Travel agencies collecting payments but never confirming hotel bookings, flight tickets etc. Until you reach your destination (often a foreign country!) and find out.
  3. Completely “hidden” charges beyond the headline package price. Package includes visa fees, resort transfers, meals, museum entries & tips that your family suddenly finds double the quoted price at check out?
  4. Operators who cancel tours for “operational reasons” or “minimum group size not met” but refuse to refund your hard-earned money – forcing you to take whatever worthless “credit voucher” they offer instead.
  5. Fly-by-night operators disappearing after collecting advance holiday tour payments. Website suddenly down. Phone switched off.
  6. Broken-down buses mid tour. Non-functional air-conditioners in promised air-conditioned coaches. Irritatingly amateur local guides substituting trained tour coordinators.
  7. Guarantee your visa will be approved agents refusing to refund visa application processing fees when the Embassy rejects your visa even though it was their mistake in the first place!

Consumer Protection Act 2019 — Your Legal Weapon

The Consumer Protection Act, 2019 (updated version of the old CPA, 1986) is your primary weapon against unfair trade practices by travel agents and tour operators. Here’s what you should know about the law:

A consumer is anyone who pays for goods or services for personal use.

Deficiency in service includes any deficiency, fault, imperfection, shortcoming or inadequacy in the quality of service promised. If you booked a deluxe room but got standard, that’s deficiency in service. If your travel agency didn’t provide the guided tours included in your package it’s deficiency.

What about unfair trade practice?

Includes any trade practice which, for promoting the sale, use or disposal of any service, distorts the judgement of consumers. Practically every travel scam we’ve listed above includes an element of unfair trade practice.

Do these laws apply to holiday tours? Domestic and international travel packages are services covered under the Consumer Protection Act.

Evidence You Must Collect

Rule #1 in fighting travel fraud – document everything.

Rule #2 – do NOT delete that WhatsApp chat with your agent. Here’s why:

  2. Tour brochure or website screenshot

  4. Hotel booking confirmation (or lack thereof!)
  5. Copies of airline tickets
  6. Photographs at the destination
  7. Expense bills & receipts
  8. Complaint letter sent to the agency (if you haven’t written yet sit down and write ONE RIGHT NOW.)
  9. Bank statement showing payment

How to File a Consumer Complaint

Filing a consumer complaint against a travel agency can be quick, easy, and VERY affordable. Ok how do I file?

Don’t have a lawyer? That’s fine. You don’t need one for the District Consumer Forum (though I strongly recommend legal representation).

  1. STEP 1: Send a legal notice to the travel agency giving 15–30 days to refund your money and pay compensation.
  2. STEP 2: File your complaint on the eDaakhil Portal. India’s consumer complaint filing platform available in every state.
  3. STEP 3: Fill out the form & attach your evidence (screenshots, bookings, communications etc).
  4. STEP 4: Pay the nominal filing fee. Typically between ?200 to ?5,000 depending on the compensation you seek.
  5. STEP 5: Attend hearings or have your lawyer attend on your behalf.

Travel agencies cheat customers in Delhi, Mumbai, Bengaluru & Chennai. They cheat in Patna & Bhopal too. Consumer forums have grown extremely consumer friendly in recent years and will decide your case in 3–6 months if the evidence is there.

What Compensation Can You Claim?

FAQ 1: I booked a hotel holiday package but the agency gave me a different hotel – which is worse. Is this something I can complain about?

Answer: Yes. See, your holiday tour agent showing you a brochure with pictures of Sunvil Resorts Kerala but booking you into Hotel Annemart is called misrepresentation under the law. Also, when your family isn’t provided the hotel quoted in your package – that’s called deficiency in service.

India’s consumer forums have penalized travel agents for giving “smaller” hotels across every city. The comparison is simple: what did you see vs what did you get. If the brochure said Hotel Sea Mount but you stayed at Hotel Hill Mount – that’s evidence.

Send a legal notice to the agency demanding a refund & compensation for the difference in hotel tariff. plus mental harassment caused to you and your family.

You can claim: partial refund (difference in hotel tariffs), compensation for mental agony and harassment, litigation costs. Tip: some agents will offer you a ‘partial refund’ voluntarily to ‘avoid dispute’. Remember what I said about evidence? Take it, but also remember you can claim compensation above and beyond the refund for harassment.

FAQ 2: My travel agency cancelled my tour at the last minute and now they’re giving me a “credit voucher” instead of refunding my cash. Don’t I have a right to a refund? ?

Answer: Absolutely. Sending you an agency “travel voucher” worth Rs. 20,000 when you paid Rs. 50,000 in cash is NOT a refund. Travel agents cannot force you to accept a voucher.

This came up a lot during the COVID-19 lockdown & post lockdown period. But Consumer Forums all over India rejected the voucher argument. From metro cities like Mumbai & Delhi to Lucknow and Patna the law is clear when a travel agency owes you a refund of money paid for services, they cannot offer you vouchers instead.

Your options are clear. Reject the voucher in writing (email is fine, but I recommend sent a copy via Speed Post as well) and demand a full refund within 15 days. If they refuse consumer complaint.

Make sure you send them a legal notice first, demanding refund within 15 days. If they don’t comply, go ahead and file a consumer complaint. Remember to mention your agent refused to refund and is now forcing you to accept a voucher.

Important: Never agree to a “settlement” and accept that voucher from the agent without talking to a lawyer first. It may prevent you from filing a consumer complaint later.

FAQ 3: My travel agent in Lucknow got my visa rejected because he put the wrong date of birth. Can I at least claim a refund on the visa application fee he charged me?

Answer: Yes and should. And when the visa is rejected due to their mistake in documentation, spelling, photos etc the agent is liable to pay you back the full amount you paid including the visa application charges.

Clients from Lucknow, Patna, Bhopal, Indore, and Nagpur have won similar cases before State Consumer Commissions after their visas were rejected due to agent error. Proving the rejection was due to their error/not you is key. If you are given a rejection letter by the embassy citing documentation flaws – that works in your favour.

You can claim: refund of visa fees, tour cost (you cannot take the tour now), any non-refundable flight ticket cost, compensation for mental agony and harassment, loss of leave you took from work to travel. If they explicitly guaranteed your visa would be approved – you can even claim damages against the agent for misrepresentation.

Tip: keep that visa rejection letter. It’s crucial evidence. Save all emails and communication with the agent where he assured you it’d be “no problem” or “because of COVID your visa might get delayed” etc.

Send a legal notice to the agent demanding refund and compensation. If no response/compliance – file consumer complaint within two years.

FAQ 4: I booked my tour package through an online website. Are online agencies also liable?

Answer: Yes. Clearly & expressly. The Consumer Protection Act covers e-commerce transactions within its definitions.

If you booked through Cleartrip or MakeMyTrip in Delhi & Mumbai or any website smaller/localized to cities like Kochi or Bhubaneswar – you have consumer rights.

India’s consumer protection law has specific provisions covering online sellers and unfair trade practices by e-commerce websites. There are even additional rules specifically for e-commerce under the Consumer Protection (E-Commerce) Rules, 20 20.

You cannot be misled by false advertising on a travel website. Hidden fees inclusions you only realised at checkout, agents refusing to reply to your WhatsApp messages, obstructive customer care these are things consumer forums can punish.

The bottom line: Websites don’t get to disclaim liability by mentioning “Refund Policy” in the terms and conditions in tiny print on their website. No one reads those. But consumer forums have been upholding this since before the Information Technology Act was even passed.

Remember: If an online portal charged you Rs. 20,000 for a package and said they will confirm within 24 hours – then refuses to confirm or refund your money even after multiple calls and emails – that’s a deficiency in service.

FAQ 5: The travel agency is nowhere to be found. Now what? ?

Answer: Small-time operators tend to do this a lot. Especially if the agency isn’t even registered (most tourist aren’t!). However, there are two ways to fight back.

First – and simpler route: file your consumer complaint against the agency’s last known address, against the proprietor/ director personally and against any companies they are “acting on behalf of”.

Consumer commissions can order compensation be paid to you directly – and pass orders against their bank accounts and property.

Second: file a criminal complaint against the agency with your local police station. Urban Crime Stoppers/CID handles these kinds of complaints in cities like Mumbai & Delhi. But you can do this in Jaipur & Bhubaneswar too.

Section 318 of Bharatiya Nyaya Sanhita, 20 23 applies to cheating by personation and cheating by causing a person to believe that he will by wrongful means. File a FIR in offences under this section.

Both routes work best if other consumers have been similarly cheated by the same travel agency. One complaint seems like a coincidence. Three or more isn’t.

Also check if your tour operator was a part of IATA/TAAI you can file a complaint directly with them. Some states also have tourism regulatory boards.

Tip: Trust me – filing a complaint creates legal record of the fraud. Even if agents “lose their license” from the NCDRC or state level complaints – it prevents them from simply opening shop under a different brand tomorrow. File that complaint.

FAQ 6: Our Goa honeymoon trip totally ruined our marriage. Can we complain about mental trauma?

Answer: Hell yes. Consumer commissions all over India have recognised the value of a honeymoon when awarding compensation for mental agony & harassment.

Want food for thought the next time your agent offers you a “partial refund to avoid dispute”? The Supreme Court & NCDRC have recognised that your time is valuable too. Yes – Courts in India have awarded compensation to consumers for #RuinedHoneymoons. Consumer commissions have consistently awarded compensation for “loss of a once in a lifetime experience” when agencies fail to deliver.

Consumer claims from Delhi, Mumbai & Bengaluru Bangalore to Hyderabad and Chennai Chennai city in particular have won compensation when tours don’t live up to promotional materials. If your Goa family trip is “picture perfect” but your husband refuses to speak to you – it’s something tangible that Consumer Forums recognise.

Tip: Take lots of pictures. Not just your horrid hotel & meals. Bill everything – keep every receipt. Save those WhatsApp chats. Write a detailed account of your “holiday experience” on returning home. File your complaint within TWO years of your honeymoon.

FAQ 7: The travel agency refused to refund saying their “terms and conditions” mentioned “no refund policy”. Can they do that?

Answer: Nope. While your travel agent hiding in tiny-print “refund policy” in their terms and conditions seem smart – the law has something called unfair contract terms.

No refund clauses are classic examples of unfair contract terms under Section 2(46) of the Consumer Protection Act. If a contract term puts an unreasonable restriction on consumers – consumer forums can strike it down.

The Supreme Court & every consumer forum in India has held repeatedly that consumers are NOT bound by unfair contract terms buried in lengthy „terms and conditions“ no one reads.

Consumer have the rights to get out of such contracts for free when services aren’t delivered as promised. While a “no refund” clause prevents you from canceling your holiday tour it does NOT permit the agency to cheat you if they fail to provide the package paid for.

FAQ 8: How long can I wait to file a consumer complaint?

Answer: Consumer complaints for travel disputes must be filed within TWO years of the cause of action arising.

When does the cause of action arise in travel fraud complaints? Usually, three scenarios:

Consumer commissions do have the power to allow complaints after two years if you provide a sufficient reason for the delay. If you were out of the country, sick etc courts & consumer forums are understanding. They’ve admitted complaints after 2 years where consumers show they were genuinely unaware of their rights.

However – caveat_consumeris_emperor. Don’t wait. The largest cause of delay complaints I see are consumers who spend years “calling and emailing the agent to sort it out”.

Lodging a consumer complaint against the agency is the SINGLE BEST thing you can do to get your money back. It preserves your legal rights. Shows the agency you mean business.

FAQ 9: But I booked my travel package with a friend who has his own travel agency.. we’re relatives. Can I still file a complaint?

Answer: Yes, you can – and it doesn’t stop you from exercising your legal rights as a consumer.

Travel agents cannot twist your arm into dropping a consumer dispute just because you know them personally. The CPA does not have an exception clause for relatives going on family holidays together. If your paid for service was not provided, or was deficient – you can file against the agency.

Lawyers notice this a lot. Consumers avoid filing complaints against friends,Out of fear? Guilt? Because you think your friends/business partner will “find out” you sent them to consumer court and lose business?

While the emotional factor is difficult – try and remember that DELETE THIS evidence. Prefer cashless payments whenever possible. Get emails/written confirmations for everything.

Surprisingly – Courts/Judges inLucknow, Patna, Bhopal, Indore, Varanasi do accept WhatsApp chats. TAAI/IATA registered agencies can be professionally threatened too.

FAQ 10: I live in a small town. Can I file a complaint or do I have to travel to Delhi?

Answer: File your complaint in YOUR city. That’s the beauty of India’s consumer protection laws.

While the NCDRC oversees the entire country – consumer disputes can & are filed at the district level in every state. State Consumer Disputes Redressal Commissions hear claims up to ?50 Lakh, with the State having their own rules/consumer commissions in each city.
